Millennium Chambers is pleased to report a successful sentencing outcome secured by Kira Chana, who represented her client at sentence in an unlawful act manslaughter case.
The case arose from a robbery at a petrol station during which a member of staff suffered a fatal heart attack whilst attempting to intervene.
A central issue at sentence was whether the defendant should be found dangerous. The prosecution also submitted that the offence should be sentenced within Category B of the Sentencing Council’s guidelines.
On behalf of her client, Kira Chana made submissions that a finding of dangerousness was not justified and that the case properly fell within a lower culpability category, as the higher culpability factors relied upon by the prosecution were not present.
The judge accepted Kira Chana’s submissions, declining to find her client dangerous and rejecting the prosecution’s approach to categorisation.
