Millennium Chambers is pleased to report a successful outcome secured by Jabeen Akhtar, who achieved the unanimous acquittal of her client following trial on a charge of serious assault.
The case concerned allegations that a man in his 50s had seriously assaulted his partner outside a social club, resulting in significant injuries, including fractures to the orbital bones around her eye. The prosecution alleged that the defendant had repeatedly kicked the complainant whilst she was on the ground.
There were no eyewitnesses to the incident. The prosecution relied on CCTV evidence said to demonstrate that no other individuals were present at the time the injuries were sustained, together with an alleged admission made by the defendant when initially confronted.
In police interview and at trial, the defendant maintained that he had no recollection of the incident.
Jabeen Akhtar conducted detailed cross-examination of the witnesses relating to the alleged admission and undertook careful analysis of the CCTV evidence relied upon by the prosecution. These issues formed a central part of the defence case.
Following trial, the jury returned a unanimous not guilty verdict.
