A single-count indictment alleging sexual assault against a police officer has been quashed following legal submissions made on behalf of the defendant.
The allegation arose during an incident in which an on-duty police officer was called to attend, leading to the defendant’s arrest. The prosecution subsequently preferred an indictment alleging sexual assault committed against the officer.
Following argument advanced by Kira Chana, the court ruled that the indictment could not stand and ordered that it be quashed, bringing the proceedings to an end.
Kira Chana appeared for the defence and was instructed by Mahesh Ramdath of Pillai & Jones Solicitors.
This outcome highlights the importance of careful scrutiny of charging decisions and the proper application of legal principles governing indictments in serious allegations.
