Millennium Chambers is pleased to report a successful outcome for Tess McCarthy, who argued exceptional hardship on behalf of her client at Brighton Magistrates’ Court.
The defendant appeared before the court having accumulated the maximum number of penalty points under the strict “totting up” scheme, making them subject to a mandatory six-month driving disqualification.
On behalf of her client, Tess McCarthy advanced an exceptional hardship application supported by detailed evidence, including maps; mileage records; and personal mitigation. The submissions demonstrated the significant impact that a disqualification would have not only on the defendant, but also on their family and place of work.
Having considered the evidence and submissions, the court accepted that exceptional hardship had been established. As a result, the defendant was permitted to retain their driving licence.
