Tamarin Hepple successfully argued that the Court should permit the defendant to withdraw his previous consent to summary trial and reopen allocation.
The application was opposed by the Crown. In detailed written and oral submissions, Tamarin relied upon the principles in R v Birmingham Justices, ex parte Hodgson, arguing that the defendant had not properly understood the nature and significance of his original election.
Following submissions, the Bench granted the application. Allocation was reopened and the defendant elected trial in the Crown Court.
