A youth client has been found Not Guilty of assault occasioning actual bodily harm following a contested trial in the Youth Court.
The client faced allegations of assault occasioning actual bodily harm and stood trial alongside a co-defendant. The co-defendant had previously been convicted in relation to the same incident.
During the trial, Tess McCarthy, Pupil Barrister at Millennium Chambers, successfully advanced a defence of self-defence, supported by detailed submissions on joint enterprise and causation in respect of the complainant’s injuries.
In closing submissions, Tess carefully addressed the legal framework governing self-defence, the limits of joint enterprise, and whether the prosecution had proved that the alleged actions of the youth defendant caused the injuries complained of.
The Magistrates accepted the defence submissions in full and returned a Not Guilty verdict.
As a result, the young defendant retains a clean record, bringing the proceedings to a successful conclusion.
